Data Protection<\/h2><\/div><div class=\"fusion-text fusion-text-1\"><p>1.1 By submitting personal data, the user confirms that he\/she is aware of the terms and conditions of data protection, that he\/she agrees with their wording and that he\/she accepts them in their entirety.<\/p>\n<p>1.2 The Provider is the controller of the User&#8217;s personal data pursuant to Article 4(7) of Regulation (EU) 2016\/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation) (hereinafter: &#8220;GDPR&#8221;). The Provider undertakes to process personal data in accordance with the legal regulations, in particular the GDPR. GDPR.<\/p>\n<p>1.3 Personal data is any information about an identified or identifiable natural person; an identifiable natural person is a&nbsp;natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a&nbsp;name, an identification number, location data, a&nbsp;network identifier or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.<\/p>\n<p>1.4 When placing an order, the personal data required for the successful execution of the order (name and address, contact details) are requested. The purpose of the processing of personal data is to process the User&#8217;s order and to exercise the rights and obligations arising from the contractual relationship between the Provider and the User. The purpose of processing personal data is also to send commercial communications and to carry out other marketing activities. The lawful grounds for processing personal data are the performance of a&nbsp;contract pursuant to Article 6(1)(b) GDPR, the fulfilment of a&nbsp;legal obligation of the controller pursuant to Article 6(1)(c) GDPR and the legitimate interest of the Provider pursuant to Article 6(1)(f) GDPR. The legitimate interest of the Provider is the processing of personal data for direct marketing purposes.<\/p>\n<p>1.5 For the performance of the license agreement, the Provider uses the services of subcontractors, in particular a&nbsp;mailing service provider (personal data is stored in 3rd countries) and a&nbsp;web hosting provider. Subcontractors are vetted for the secure processing of personal data. The provider and the web hosting subcontractor have entered into a&nbsp;data processing agreement, according to which the subcontractor is responsible for the proper security of the physical, hardware and software perimeter and is therefore directly liable to the user for any leakage or breach of personal data.<\/p>\n<p>1.6 The Provider stores the User&#8217;s personal data for the period necessary to exercise the rights and obligations arising from the contractual relationship between the Provider and the User and to assert claims arising from such contractual relationship (for a&nbsp;period of 15 years from the termination of the contractual relationship). Upon expiry of this period, the data will be deleted.<\/p>\n<p>1.7 The User has the right to request from the Provider access to his\/her personal data pursuant to Article 15 GDPR, rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR. The User has the right to erasure of personal data pursuant to Article 17(1)(a), and (c) to (f) GDPR. Furthermore, the user has the right to object to processing pursuant to Article 21 GDPR and the right to data portability pursuant to Article 20 GDPR.<\/p>\n<p>1.8 The user has the right to lodge a&nbsp;complaint with the Data Protection Authority if he\/she believes that his\/her right to data protection has been violated.<\/p>\n<p>1.9 The User is under no obligation to provide personal data. However, the provision of personal data is a&nbsp;necessary requirement for the conclusion and performance of the contract and without the provision of personal data the contract cannot be concluded or performed by the provider.<\/p>\n<p>1.10 There is no automatic individual decision-making on the part of the Provider within the meaning of No. 22 GDPR.<\/p>\n<p>1.11 Z\u00e1jemce o&nbsp;vyu\u017e\u00edv\u00e1n\u00ed slu\u017eeb Poskytovatele vypln\u011bn\u00edm kontaktn\u00edho formul\u00e1\u0159e:<\/p>\n<ul>\n<li>souhlas\u00ed s&nbsp;pou\u017eit\u00edm sv\u00fdch osobn\u00edch \u00fadaj\u016f pro \u00fa\u010dely elektronick\u00e9ho zas\u00edl\u00e1n\u00ed obchodn\u00edch sd\u011blen\u00ed, reklamn\u00edch materi\u00e1l\u016f, p\u0159\u00edm\u00e9ho prodeje, pr\u016fzkum\u016f trhu a&nbsp;p\u0159\u00edm\u00fdch nab\u00eddek produkt\u016f ze strany Poskytovatele a&nbsp;t\u0159et\u00edch subjekt\u016f, ne v\u0161ak \u010dast\u011bji, ne\u017e 1x t\u00fddn\u011b, a&nbsp;z\u00e1rove\u0148<\/li>\n<li>prohla\u0161uje, \u017ee zas\u00edl\u00e1n\u00ed informac\u00ed dle bodu 1.11.1 nepova\u017euje za nevy\u017e\u00e1danou reklamu ve smyslu z\u00e1k. \u010d.&nbsp;40\/1995 Sb. ve zn\u011bn\u00ed novel, nebo\u0165 u\u017eivatel se zas\u00edl\u00e1m informac\u00ed dle bodu 1.11.1 ve spojen\u00ed s&nbsp;\u00a7 7 z\u00e1k. \u010d.&nbsp;480\/2004 Sb. v\u00fdslovn\u011b souhlas\u00ed.<\/li>\n<li>Souhlas dle tohoto odstavce m\u016f\u017ee u\u017eivatel kdykoli p\u00edsemn\u011b odvolat na <a href=\"mailto:info@marsys.cz\"><strong>info@marsys.cz<\/strong><\/a><\/li>\n<\/ul>\n<p>1.12 The Provider uses cookies in its presentation to improve the quality of its services, to personalize its offer, to collect anonymous data and for analytical purposes. Rights and obligations between the controller and the processor (processing contract)<\/h2><\/div><div class=\"fusion-text fusion-text-2\"><p>2.1 Poskytovatel je ve vztahu k&nbsp;osobn\u00edm \u00fadaj\u016fm klient\u016f u\u017eivatel\u016f zpracovatelem dle \u010dl. 28 GDPR. U\u017eivatel je spr\u00e1vcem t\u011bchto \u00fadaj\u016f.<\/p>\n<p>2.2 Tyto podm\u00ednky upravuj\u00ed vz\u00e1jemn\u00e1 pr\u00e1va a&nbsp;povinnosti p\u0159i zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f, ke kter\u00fdm Poskytovatel z\u00edskal p\u0159\u00edstup v&nbsp;r\u00e1mci pln\u011bn\u00ed licen\u010dn\u00ed smlouvy uzav\u0159en\u00e9 formou odsouhlasen\u00ed v\u0161eobecn\u00fdch obchodn\u00edch podm\u00ednek na <a href=\"http:\/\/www.marsys.cz\"><strong>www.marsys.cz<\/strong><\/a> (d\u00e1le jen \u201elicen\u010dn\u00ed smlouva\u201c) uzav\u0159en\u00e9 s&nbsp;U\u017eivatelem ke dni z\u0159\u00edzen\u00ed u\u017eivatelsk\u00e9ho \u00fa\u010dtu.<\/p>\n<p>2.3 Poskytovatel se zavazuje pro U\u017eivatele zpracov\u00e1vat osobn\u00ed \u00fadaje v&nbsp;rozsahu a&nbsp;za \u00fa\u010delem stanoven\u00fdmi v&nbsp;\u010dl. 2.4 &#8211; 2.7 t\u011bchto podm\u00ednek. Prost\u0159edky zpracov\u00e1n\u00ed budou automatizovan\u00e9. Poskytovatel bude v&nbsp;r\u00e1mci zpracov\u00e1n\u00ed osobn\u00ed \u00fadaje shroma\u017e\u010fovat, ukl\u00e1dat na nosi\u010de informac\u00ed, uchov\u00e1vat, blokovat a&nbsp;likvidovat. Poskytovatel nen\u00ed opr\u00e1vn\u011bn osobn\u00ed \u00fadaje zpracov\u00e1vat v&nbsp;rozporu nebo nad r\u00e1mec stanoven\u00fd t\u011bmito podm\u00ednkami.<\/p>\n<p>2.4 Poskytovatel se zavazuje pro u\u017eivatele zpracov\u00e1vat osobn\u00ed \u00fadaje v&nbsp;tomto rozsahu:<\/p>\n<p>b\u011b\u017en\u00e9 osobn\u00ed \u00fadaje,<br \/>\nzvl\u00e1\u0161tn\u00ed kategorie \u00fadaj\u016f podle \u010dl. 9 GDPR, kter\u00e9 U\u017eivatel z\u00edskal v&nbsp;souvislosti s&nbsp;vlastn\u00ed obchodn\u00ed \u010dinnost\u00ed.<\/p>\n<p>2.5 Poskytovatel se zavazuje pro u\u017eivatele zpracov\u00e1vat osobn\u00ed \u00fadaje za \u00fa\u010delem zpracov\u00e1n\u00ed popt\u00e1vek a&nbsp;po\u017eadavk\u016f klient\u016f z\u00edskan\u00fdch z&nbsp;kontaktn\u00edho formul\u00e1\u0159e.<\/p>\n<p>2.6 Osobn\u00ed \u00fadaje je mo\u017en\u00e9 zpracov\u00e1vat pouze na pracovi\u0161t\u00edch Poskytovatele nebo jeho subdodavatel\u016f podle \u010dl. 2.8 t\u011bchto podm\u00ednek, a&nbsp;to na \u00fazem\u00ed Evropsk\u00e9 unie.<\/p>\n<p>2.7 Poskytovatel se zavazuje pro U\u017eivatele zpracov\u00e1vat osobn\u00ed \u00fadaje klient\u016f U\u017eivatele, to v\u0161e po dobu nezbytnou k&nbsp;v\u00fdkonu pr\u00e1v a&nbsp;povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch ze smluvn\u00edho vztahu mezi Poskytovatelem a&nbsp;U\u017eivatelem a&nbsp;z&nbsp;uplat\u0148ov\u00e1n\u00ed n\u00e1rok\u016f z&nbsp;t\u011bchto smluvn\u00edch vztah\u016f (po dobu 15 let od ukon\u010den\u00ed smluvn\u00edho vztahu).<\/p>\n<p>2.8 U\u017eivatel ud\u011bluje povolen\u00ed se zapojen\u00edm subdodavatele jako\u017eto dal\u0161\u00edho zpracovatele podle \u010dl. 28 odst. 2 GDPR, kter\u00fdm je poskytovatel hostingu aplikace. U\u017eivatel d\u00e1le ud\u011bluje Poskytovateli obecn\u00e9 povolen\u00ed zapojit do zpracov\u00e1n\u00ed dal\u0161\u00edho zpracovatele osobn\u00edch \u00fadaj\u016f, Poskytovatel v\u0161ak mus\u00ed u\u017eivatele p\u00edsemn\u011b informovat o&nbsp;v\u0161ech zam\u00fd\u0161len\u00fdch zm\u011bn\u00e1ch t\u00fdkaj\u00edc\u00edch se p\u0159ijet\u00ed dal\u0161\u00edch zpracovatel\u016f nebo jejich nahrazen\u00ed a&nbsp;poskytnout u\u017eivateli mo\u017enost vyslovit v\u016f\u010di t\u011bmto zm\u011bn\u00e1m n\u00e1mitky. Poskytovatel mus\u00ed ulo\u017eit sv\u00fdm subdodavatel\u016fm v&nbsp;postaven\u00ed zpracovatele osobn\u00edch \u00fadaj\u016f stejn\u00e9 povinnosti na ochranu osobn\u00edch \u00fadaju\u00b0, jak jsou stanoveny v&nbsp;t\u011bchto podm\u00ednk\u00e1ch.<\/p>\n<p>2.9 Poskytovatel se zavazuje, \u017ee zpracov\u00e1v\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f bude zabezpe\u010deno zejm\u00e9na n\u00e1sleduj\u00edc\u00edm zp\u016fsobem:<\/p>\n<ul>\n<li>Osobn\u00ed \u00fadaje jsou zpracov\u00e1v\u00e1ny v\u00a0souladu s\u00a0pr\u00e1vn\u00edmi p\u0159edpisy a\u00a0na z\u00e1klad\u011b pokyn\u016f U\u017eivatele, tj.\u00a0pro v\u00fdkon ve\u0161ker\u00fdch \u010dinnost\u00ed pot\u0159ebn\u00fdch pro poskytov\u00e1n\u00ed webov\u00e9 platmormy.<\/li>\n<li>Poskytovatel se zavazuje, \u017ee technicky a\u00a0organiza\u010dn\u011b zabezpe\u010d\u00ed ochranu zpracov\u00e1van\u00fdch osobn\u00edch \u00fadaj\u016f tak, aby nemohlo doj\u00edt k\u00a0neopr\u00e1vn\u011bn\u00e9mu nebo nahodil\u00e9mu p\u0159\u00edstupu k\u00a0\u00fadaj\u016fm, k\u00a0jejich zm\u011bn\u011b, zni\u010den\u00ed \u010di\u00a0ztr\u00e1t\u011b, neopr\u00e1vn\u011bn\u00fdm p\u0159enos\u016fm, k\u00a0jejich jin\u00e9mu neopr\u00e1vn\u011bn\u00e9mu zpracov\u00e1n\u00ed, jako\u017e i\u00a0k\u00a0jin\u00e9mu zneu\u017eit\u00ed a\u00a0aby byly person\u00e1ln\u011b a\u00a0organiza\u010dn\u011b nep\u0159etr\u017eit\u011b po\u00a0dobu zpracov\u00e1v\u00e1n\u00ed \u00fadaj\u016f zabezpe\u010deny ve\u0161ker\u00e9 povinnosti zpracovatele osobn\u00edch \u00fadaj\u016f, vypl\u00fdvaj\u00edc\u00ed z\u00a0pr\u00e1vn\u00edch p\u0159edpis\u016f.<\/li>\n<li>P\u0159ijat\u00e1 technick\u00e1 a\u00a0organiza\u010dn\u00ed opat\u0159en\u00ed odpov\u00eddaj\u00ed m\u00ed\u0159e rizika. Poskytovatel pomoc\u00ed nich zaji\u0161\u0165uje neust\u00e1lou d\u016fv\u011brnost, integritu, dostupnost a\u00a0odolnost syst\u00e9m\u016f a\u00a0slu\u017eeb zpracov\u00e1n\u00ed, a\u00a0v\u010das obnovuje dostupnost osobn\u00edch \u00fadaj\u016f a\u00a0p\u0159\u00edstup k\u00a0nim v\u00a0p\u0159\u00edpad\u011b fyzick\u00fdch \u010di\u00a0technick\u00fdch incident\u016f.<\/li>\n<li>Poskytovatel t\u00edmto prohla\u0161uje, \u017ee ochrana osobn\u00edch \u00fadaj\u016f podl\u00e9h\u00e1 intern\u00edm bezpe\u010dnostn\u00edm p\u0159edpis\u016fm Poskytovatele.<\/li>\n<li>K&nbsp;osobn\u00edm \u00fadaj\u016fm budou m\u00edt p\u0159\u00edstup pouze opr\u00e1vn\u011bn\u00e9 osoby Poskytovatele a\u00a0subdodavatel\u016f dle \u010dl. 2.8 t\u011bchto podm\u00ednek, kter\u00e9 budou m\u00edt Poskytovatelem stanoveny podm\u00ednky a\u00a0rozsah zpracov\u00e1n\u00ed \u00fadaj\u016f a\u00a0ka\u017ed\u00e1 takov\u00e1 osoba bude p\u0159istupovat k\u00a0osobn\u00edm \u00fadaj\u016fm pod sv\u00fdm jednozna\u010dn\u00fdm identifik\u00e1torem.<\/li>\n<li>Opr\u00e1vn\u011bn\u00e9 osoby Poskytovatele, kter\u00e9 zpracov\u00e1vaj\u00ed osobn\u00ed \u00fadaje podle t\u011bchto podm\u00ednek, jsou povinny zachov\u00e1vat ml\u010denlivost o\u00a0osobn\u00edch \u00fadaj\u00edch a\u00a0o\u00a0bezpe\u010dnostn\u00edch opat\u0159en\u00edch, jejich\u017e zve\u0159ejn\u011bn\u00ed by ohrozilo jejich zabezpe\u010den\u00ed. Poskytovatel zajist\u00ed jejich prokazateln\u00e9 zav\u00e1z\u00e1n\u00ed k\u00a0t\u00e9to povinnosti. Poskytovatel zajist\u00ed, \u017ee tato povinnost pro Poskytovatele i\u00a0opr\u00e1vn\u011bn\u00e9 osoby bude trvat i\u00a0po\u00a0skon\u010den\u00ed pracovn\u011b pr\u00e1vn\u00edho nebo jin\u00e9ho vztahu k\u00a0Poskytovateli.<\/li>\n<li>Poskytovatel bude u\u017eivateli n\u00e1pomocen prost\u0159ednictv\u00edm vhodn\u00fdch technick\u00fdch a\u00a0organiza\u010dn\u00edch opat\u0159en\u00ed, pokud je to mo\u017en\u00e9, pro spln\u011bn\u00ed u\u017eivatelovy povinnosti reagovat na \u017e\u00e1dosti o\u00a0v\u00fdkon pr\u00e1v subjektu \u00fadaj\u016f stanoven\u00fdch v\u00a0GDPR; stejn\u011b tak p\u0159i\u00a0zaji\u0161\u0165ov\u00e1n\u00ed souladu s\u00a0povinnostmi podle \u010dl. 32 a\u017e 36 GDPR, a\u00a0to p\u0159i\u00a0zohledn\u011bn\u00ed povahy zpracov\u00e1n\u00ed a\u00a0informac\u00ed, je\u017e m\u00e1 Poskytovatel k\u00a0dispozici.<\/li>\n<li>Po ukon\u010den\u00ed poskytov\u00e1n\u00ed pln\u011bn\u00ed, kter\u00e9 je spojeno se zpracov\u00e1n\u00edm, dle \u010dl. 2.7 t\u011bchto podm\u00ednek, je Poskytovatel povinen v\u0161echny osobn\u00ed \u00fadaje vymazat, nebo je vr\u00e1tit U\u017eivateli, pokud nem\u00e1 povinnost ulo\u017eit osobn\u00ed \u00fadaje na z\u00e1klad\u011b zvl\u00e1\u0161tn\u00edho z\u00e1kona.<\/li>\n<li>Poskytovatel poskytne U\u017eivateli ve\u0161ker\u00e9 informace pot\u0159ebn\u00e9 k\u00a0dolo\u017een\u00ed toho, \u017ee byly spln\u011bny povinnosti podle t\u00e9to smlouvy a\u00a0GDPR, umo\u017en\u00ed audity, v\u010detn\u011b inspekc\u00ed, prov\u00e1d\u011bn\u00e9 U\u017eivatelem nebo jin\u00fdm auditorem, kter\u00e9ho u\u017eivatel pov\u011b\u0159il.<\/li>\n<\/ul>\n<p>2.10 U\u017eivatel se zavazuje neprodlen\u011b ohla\u0161ovat v\u0161echny jemu zn\u00e1m\u00e9 skute\u010dnosti, kter\u00e9 by mohly nep\u0159\u00edzniv\u011b ovlivnit \u0159\u00e1dn\u00e9 a&nbsp;v\u010dasn\u00e9 pln\u011bn\u00ed z\u00e1vazk\u016f vypl\u00fdvaj\u00edc\u00edch z&nbsp;t\u011bchto podm\u00ednek na a&nbsp;poskytnout Poskytovateli sou\u010dinnost nezbytnou pro pln\u011bn\u00ed t\u011bchto podm\u00ednek.<\/p>\n<\/div><style type=\"text\/css\">@media only screen and (max-width:1024px) {.fusion-title.fusion-title-3{margin-top:10px!important; margin-right:0px!important;margin-bottom:15px!important;margin-left:0px!important;}}@media only screen and (max-width:640px) {.fusion-title.fusion-title-3{margin-top:10px!important; margin-right:0px!important;margin-bottom:10px!important; margin-left:0px!important;}}<\/style><div class=\"fusion-title title fusion-title-3 fusion-sep-none fusion-title-text fusion-title-size-two\" style=\"margin-top:10px;margin-right:0px;margin-bottom:15px;margin-left:0px;\"><h2 class=\"title-heading-left\" style=\"margin:0;\">III. Final Provisions<\/h2><\/div><div class=\"fusion-text fusion-text-3\"><p>3.1 These conditions expire at the end of the period specified in Article 1.6 and Article 2.7 of these conditions.<\/p>\n<p>3.2 The user agrees to these conditions by checking the consent via the online form. By checking the consent, the user expresses that he has read these conditions, that he expresses his consent to them and that he accepts them in full.<\/p>\n<p>3.3 The Provider is entitled to change these conditions.
